ANN ARBOR, MI – A proposal to increase the minimum legal age to purchase tobacco products in Ann Arbor from 18 to 21 awaits final approval from the City Council. The council voted 10-1 Monday night, July 18, to advance the proposed ordinance to a public hearing and possible final approval on Aug. Council Member Jack Eaton, an attorney, argued so as he cast the lone dissenting vote against the proposed ordinance. Eaton, D-4th Ward, cited Michigan's Tobacco Products Tax Act of 1993, which states that local governments "shall not impose any new requirement or prohibition pertaining to the sale or licensure of tobacco products for distribution purposes. "And that's exactly what we're doing here," Eaton said of the proposed ordinance that a majority of council members still support. "I think that where there's a state law that tells us not to do something, then we're ill-advised to do it, regardless of how compassionate we are about the intent behind the law, so I won't be supporting this — not because I don't think it's a... City Attorney Stephen Postema said Eaton has correctly read the state law and there are legal issues that will continue to be looked at. Council Member Sumi Kailasapathy, D-1st Ward, asked Postema what the legal ramifications might be if the city... " Kailasapathy said, pushing for an open discussion about it. "At this point, the ramifications — you know, it's a more lengthy legal analysis and I'm not prepared to do it here, and I never do it here," Postema responded. A tobacco product is defined as any product that contains tobacco, is derived from tobacco or... That does not include any cessation product approved by the U. S. Food and Drug Administration to treat nicotine or tobacco dependence. The proposed ordinance also explicitly prohibits selling, giving or furnishing any electronic smoking device to a person under 21. "To the extent that other communities have taken this action and we can help be a leader in Michigan, I think that's worthwhile," Westphal said.
